GENERAL INFORMATION

This agreement contains the entire understanding between Bianca Gillen Photo [BGP] and you, the client. The only way to add or change this agreement is to do so in writing, signed by all the parties.
COOPERATION. The client and BGP consent to happily cooperating and communicating with each other to achieve the best possible result within understanding of this contract.
SAFETY. All children must be accompanied by an adult at all times. BGP is not liable for the safety or care of the children at any time during the session.
RESCHEDULING AND RESHOOTING. In the event of an illness or emergency, please call as soon as possible to reschedule. BGP reserves the right to reschedule due to illness, inclement weather, equipment malfunction, or other circumstances beyond it’s control.
Requests for rescheduling or re-shoots by the client due to difficulty in cooperation from the children, are granted only at BGP’s discretion. The decision to reshoot must be made within the first 30 minutes of the session. The client is allowed one reshoot per original session. An additional fee of $100 will be applied to your invoice for the re-shoot.
ILLNESS. If any member of the client’s family is running a fever within 24 hours of the session, the client is responsible for notifying BGP to discuss a potential reschedule.
LATE ARRIVALS. Client agrees to notify BGP of session postponement as soon as possible. Late arrivals will have amount of time late deducted from the total time allotted for the session.
ARTISTIC RIGHTS. BGP retains the rights of discretion in selecting the photographic materials released to the client for the preview. The client will then be responsible for making their final selections. The amount of final images is based on the package that has been booked. The preview images are not included in the package.
BGP shall be granted artistic license in relation to the poses photographed and the locations used. BGP’s judgment regarding the location, poses, number of photographs taken, color correction in post-work shall be deemed correct. BGP is not liable to deliver every image from the session. The determination of these delivered to the client is left to the discretion of BGP.
All images delivered in the preview format are for preview purposes only and are not to be downloaded, screen shot, or posted in a public platform.
Once images are in their final edited format, the client must not alter the coloring, retouching or apply filters to any images. Raw or unedited files will not be given under any circumstance.
MODIFICATIONS. If the client has a request for an alteration of an image, please let BGP know when you send your selections. There will only be two rounds of revisions free of charge. Every revision after the first two will be charged at a rate of $50/hr.
PAYMENT. Payment will be taken at the end of the session. Cash, checks, and Venmo are all accepted. BGP will not begin post-production or process orders until payment is complete.
RETURNED CHECKS. Checks returned by the bank, for any reason, will be charged a $34.00 service fee. Sessions/orders will be cancelled if full payment is not received within three days of notification.
TRAVEL AND ADDITIONAL FEES. Travel anywhere inside the 610 Loop is free of charge. Mileage fees apply everywhere outside the 610 Loop. An additional 55 cents will be applied for every mile beyond this radius. If there are any costs/fees associated with a rental location, you, the Client, will be responsible for those fees. The BGP will not arrange payment on rental locations.
PRINT LIABILITY. The client is aware that the quality of the result of the print of the digital files delivered is not under the control of BGP. This frees BGP from any liability for any claims whatsoever based upon discoloration in the end result print. BGP is not responsible for the quality provided by its business partners.
COPYRIGHT LAW. The copyright of the photographs remains with BGP. BGP grants the Client permission to make copies of the images under the following conditions. The images taken by BGP are for personal use by the clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from BGP.
HARRASSMENT. If the client in any way harasses BGP or any of its employees or subcontractors, or interferes with the productivity of a photo shoot, post-processing, indicates a fundamental unhappiness with the product, or otherwise indicates any material lack of credibility in BGP or BGP’s ability and willingness to perform its obligations under this Agreement, then BGP may, in its sole discretion, terminate this Agreement by notice to client and refund to client any session payment. BGP shall not be obligated to return or pay to client any deposits or payments for upgrades, extras or non-standard items which have been already delivered. Upon such termination of this Agreement and return of payment, the client shall have no further remedies against BGP.
MODEL RELEASE. The client grants BGP and its legal representatives, the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Clients hereby release BGP and its legal representatives, from all liability and claims in connection with the images.
IMAGE FILES. BGP is not responsible for any equipment malfunction, damage to files, or loss of files. In the event of this occurring, BGP will reshoot the session at no charge to the client.
ARCHIVE. Client will be required to download files sent from BGP within six months of receiving final images. BGP is not responsible for the storage of the files after that time has lapsed.
We understand the contents of this contract and agree to the terms therein.
